The South African government has approached the country’s Constitutional Court in a fresh attempt to stop the proposed auction of 29 personal belongings of former President Nelson Mandela in the United States.

The legal challenge, filed by the South African Heritage Resources Agency (SAHRA), the Robben Island Museum and the Department of Sport, Arts and Culture, seeks to prevent the New York-based Guernsey’s auction house from selling the items, which the government says form part of South Africa’s national heritage.

The latest court action marks another chapter in a four-year legal dispute over Mandela’s personal effects, with the government maintaining that some of the objects cannot lawfully be exported from South Africa without the necessary heritage permits.

Among the items at the centre of the dispute are Mandela’s identity document, some of his trademark shirts, a hearing aid, written materials and a key said to be linked to his prison cell on Robben Island, where the anti-apartheid icon spent 18 of his 27 years in prison.

The proposed auction has been authorised by Mandela’s eldest daughter, Makaziwe Mandela, in conjunction with Guernsey’s. She has said the proceeds would be used to support the construction of a memorial garden beside her father’s grave in Qunu, Eastern Cape.

The dispute centres largely on whether the objects qualify as protected heritage resources under South African law.

SAHRA has argued that the items have historical and cultural significance to the country and therefore require protection from being removed and sold abroad. The agency maintains that exporting such objects without the requisite authorisation would contravene South Africa’s heritage laws.

The latest challenge comes after the Supreme Court of Appeal ruled in January that SAHRA had failed to establish why each of the 29 objects should be classified as a protected heritage object.

The court consequently dismissed the appeal seeking to stop the auction, effectively clearing the way for Makaziwe Mandela and the auction house to proceed with the sale.

The government, however, has continued its legal challenge and has now taken the matter to the Constitutional Court, South Africa’s highest court.

The case has attracted considerable public interest because of the historical significance of Mandela, who became South Africa’s first democratically elected president in 1994 after decades of opposition to apartheid.

Mandela served as president from 1994 to 1999 and died in December 2013 at the age of 95. His estate remains the subject of unresolved legal and administrative issues.

The auction dispute has therefore evolved beyond a question of private ownership, raising broader questions about where the line should be drawn between an individual’s right to dispose of personal property and a nation’s claim to objects associated with one of its most consequential historical figures.

For the South African government, the items are not merely possessions belonging to a former president. They argue that some of them represent tangible links to the country’s struggle against apartheid and its transition to democracy.

For Mandela’s family and the auction organisers, however, the proposed sale is intended to generate funds for preserving his legacy through a memorial project in Qunu.

The Constitutional Court’s consideration of the case could now determine whether the disputed objects can ultimately leave South Africa and be offered for sale in the United States, potentially bringing a fresh legal conclusion to a dispute that has stretched across several years.
