South Africa is considering tougher penalties for employers who hire undocumented foreign nationals, with proposed fines of up to R1 million (about $61,000) as the government moves to tighten immigration-related employment rules and prioritise job opportunities for citizens.

The proposed sanctions are contained in the Employment Services Amendment Bill, which is currently open for public comment until November 6.

Under the proposed legislation, employers found hiring undocumented workers would face a fine of R100,000 for each worker involved in a first offence. The penalty would increase to R200,000 per worker for a second offence committed within three years.

Repeat offenders could face fines of up to R1 million or 10 per cent of their annual turnover, whichever is applicable under the proposed framework.

The bill, introduced by Employment and Labour Minister Nomakhosazana Meth, would also strengthen the powers of labour inspectors, allowing them to conduct unannounced workplace inspections and examine employment and compliance records.

The proposed reforms would further give the government powers to establish sector-specific quotas for the employment of foreign nationals.

Employers seeking to recruit foreign workers would be required to demonstrate that they had been unable to find suitably qualified South African candidates before hiring from outside the country.

They would also be expected to establish skills-transfer programmes showing how foreign employees would train and mentor South African workers.

The proposed measures come amid longstanding concerns from government authorities, labour unions and political groups over the employment of undocumented migrants.

Critics of illegal hiring have accused some businesses of employing undocumented foreign nationals to reduce labour costs and circumvent employment regulations.

Undocumented workers are commonly found in labour-intensive sectors including agriculture, construction, hospitality, domestic work and small-scale manufacturing.

Employers have also been accused of hiring undocumented migrants because they are perceived as more likely to accept lower wages, longer working hours and fewer workplace protections.

The debate has intensified amid South Africa’s persistently high unemployment rate, particularly among young people.

Concerns over access to jobs have contributed to growing pressure on the government to strengthen enforcement against employers who breach immigration and labour regulations.

The proposed legislation, however, distinguishes between undocumented migrants and certain categories of legally protected foreign nationals.

Refugees, asylum seekers and permanent residents are specifically excluded from the bill’s definition of “foreign nationals” and would continue to enjoy employment protections under existing laws.

If adopted, the reforms would mark a significant tightening of the consequences for businesses employing undocumented workers, while placing greater responsibility on employers to demonstrate compliance with South Africa’s labour and immigration requirements.
